STUDIO POLICIES

POLICIES
REGISTRATION FEE
• There are no refunds in whole or in part for any reason on the annual Registration Fee.
• No transfers. No cancellations.

WORKSHOP OR INTENSIVE
• Workshops and Intensives are short-term training. They are paid in full in advance.
• There are no refunds in whole or in part for any reason. No transfers.

COURSE OR TRAINING PROGRAM FEES
• Blue Egg offers training and education for those pursuing careers in entertainment plus, passionate and dedicated amateurs (with other careers). We are not a recreational facility.
• Our schedule can change from time to time and going into a new Term. Your flexibility may be required and is appreciated. Changes are made to offer you the best possible training.
• A minimum of 25% of your Course Fee(s) are due at Registration and is non-refundable.
• We do not offer Refunds except if we cancel an entire Course, Workshop or Intensive. You would be Refunded any unusable portion (whole or partial, if it ran before cancellation). This does not include a course rescheduled to a new day or time.
• Additionally, you may receive a Refund prior to the third week of a Term, during the first two weeks of Term you may cancel a Course or Training Program, less 25% of your Course Fee(s) plus a Cancellation Fee of $15-$25 for Courses or $100 for a Training Program. The fee and charges are applicable even if you missed the first two sessions. As of the third week of Term, all registrations are a commitment to the end of Term or Program plus associated fees, no Refunds or Credits.
• If a Credit is issued to you, please note that it expires on the last day of the next Term.
• Courses and Registrations are not transferable to another person.
• Transferring from one course to another may be permitted mid-Term with the agreement of Blue Egg and the teachers involved.
• Part-time Training Programs & the Conservatory Program require a full training year commitment (10 months). All Training Programs include certain mandatory supportive classes. These classes help to develop you from the inside out and holistically, making your overall training more effective and efficient.
• If the need arises to cancel a part-time Training Program prior to a full training year, you are financially responsible for your program fees to the end of the current Term plus a cancellation Fee of $100.
• If you enroll in a Training Program and subsequently reduce the number of courses in your program, please note that your remaining program fee may cost you more the reason is that we have two levels of financial benefit built into our pricing to support higher levels of commitment and participation. Fewer courses in a program does not necessarily result in a lower program fee.
• Attendance & Home Practice are important and are your responsibility. If you miss a session Blue Egg may provide you a make-up class, at your own cost, or you may arrange for a private session, at your own cost.
• Please note that excessive lateness or absences may result in dismissal from training and forfeiting your fees. Your attendance and punctuality affects your learning as well as everyone in the class. Blue Egg is not a drop-in or recreational facility. This is the real deal to make you really good.
• If a session is ever cancelled by Blue Egg, Blue Egg will set a make-up session and will make every effort to select a day and time suitable to everyone for a make up class; This may not be possible due to multiple schedules.
• If there are four (4) or fewer students registered in a course, workshop or intensive (other than Acting) the length of each session may be reduced by 15 to 30 minutes until such time as five (5) or more students are registered.
• If there are five (5) or fewer students registered in an Acting course, workshop or intensive, the length of each session may be reduced by 30 to 60 minutes until such time as six (6) or more students are registered.
• Regarding the two policy points above, all courses and workshops are designed with a minimum of five to eight students in mind; if the number of participants is less, the course material may be delivered in less time than scheduled. Furthermore, a small class size is a more intensive learning experience and may be considered a semi-private, at a rate significantly below semi-private or private rates.
• You may choose to divide your course fees to pay monthly. Please note the following: a $15 Finance Fee will be incurred each Term. Completion of a Payment Agreement is required. The monthly payment will be processed automatically.
• If you choose to split your payment or pay monthly, please note that you are financially obligated for the full Course and Program fees. This is not an opportunity to commit monthly. Future or post dated payments cannot be canceled.
• The monthly payment option is a customer courtesy provided by Blue Egg and not an option to pay for only part of a course, or training program.

PROFESSIONAL DEVELOPMENT PACKAGES & PRIVATES
• There are no refunds in whole or in part for any reason on Packages.
• All packages expire 12 months or 365 days from the date of purchase.
• Full payment in advanced is required in order to schedule Privates or Semi-Privates.
• We require a minimum of 24 hours notice, by phone, to cancel a Private or Semi-Private; otherwise you will forfeit full payment. Please note, we have no office hours on the weekends; notice to cancel/change a weekend private must be received on Thursday by 6:00pm.
• No transfers.

PRODUCTS
• If you are not satisfied with a product, you may return it within 10 days, with the receipt, for a full Refund.

OTHER POLICIES & INFORMATION

PERFORMANCE & CHOREOGRAPHY POLICY
• Choreography you are taught belongs to the Choreographer. To use or perform the choreography at any time other than intended by Blue Egg or the choreographer requires written permission. Please note that a fee may be due to the choreographer.
• Auditions are generally held for performance opportunities, if you are selected for a performance your full commitment is required to rehearsals and all necessary work involved.
• Rehearsals will be scheduled for every performance. The rehearsals are mandatory; if you miss one, you may lose the opportunity to perform. You may have to pay for a subsequent rehearsal due to an absence.
• Rehearsals, in general, bear no additional fees unless you have missed one (as mentioned above) or possibly if it involves a guest teacher, coach, choreographer, etc.
• The cost of any costume required for performing may be your responsibility, and therefore, your property; costume design is either created by or agreed to by Blue Egg.

ADULT ACTING CLASSES & ATTENDANCE
• Acting is a team activity and requires your attendance commitment. A $65 Attendance Incentive Deposit payable at registration is due. The nature of Acting and the partner work involved make attendance critical to the group learning; therefore, if you miss an Acting class you lose the $65 (per missed session). Happily, this deposit will be returned to you at the end of June, if you attended all sessions.

• Please note no classes are held on Statutory Holidays, including the following long weekends: Thanksgiving, Good Friday to Easter Monday (may fall within Spring Break), Canada Day, and BC Day week.

RELEASE & WAIVER

• All students and participants must sign a Release & Waiver of Liability Form prior to participation in any activity provided by Blue Egg and thereby agree to the following Terms:

RELEASE AND WAIVER OF LIABILITY

1. The Student/Participant recognizes that Activities of the type he/she intends to participate in at Blue Egg or held by Blue Egg require physical, mental and emotional exertion and dynamic action that may be strenuous and may cause serious injury. The Student/Participant is fully aware of the risks and hazards involved and takes full responsibility for his/her well-being or any stress or injury that he/she may incur.

2. The Student/Participant understands that it is their responsibility to consult a physician prior to their participation in any Activities she/he attends offered by Blue Egg. The Student/Participant represents that he/she is healthy and has no medical condition that would prevent her/his full participation and exertion in any Activities.

3. The Student/Participant agrees to take full responsibility for any risks, injuries or damages known or unknown which he/she incurs, or may incur, as a result of participation in any Blue Egg Activities at Blue Egg or held at a separate location by Blue Egg.

4. An Instructor or Choreographer or Coach or Director may put hands on the Student/Participant in order to correct my posture, alignment, position or manner of movement or performance. It is the Student/Participant’s responsibility to voice and communicate if she/he does not want to be touched. An Instructor, Choreographer, Coach or Director may encourage the Student/Participant to push his/her boundaries, it is the Student/Participant’s responsibility to know his/her limits and communicate them.

5. The Student/Participant knowingly and voluntarily waives any and all claims he/she has, or may at any time in the future have, against Blue Egg Entertainment Inc. or any of its instructors, agents, representatives, renters or employees or The Dance Centre at Scotiabank Dance Centre, for any injury, loss or damage that the Student/Participant sustains or may sustain as a result of my participation in Blue Egg Activities.

CONDUCT & TIPS

• All of our classes are designed with your progress in mind.
• Sign-in and Sign-out at reception.
• We recommend you arrive early to class, 15 to 20 minutes before your start time. Give yourself enough time to sign-in, change and warm-up.
• Arrive hydrated and fuelled (but not full). Bring water. If necessary, a sweat towel and mat.
• Appropriate clothing is mandatory. Jewelry may be a distraction. Style your hair so that it won’t interfere with your activity; for attire, please check with your teacher or the office.
• Each change room has a limited number of lockers. Please bring your own lock. Otherwise, you will take your personal belongings into class with you and be responsible for them.
• Please note that Blue Egg and The Dance Centre are not responsible for lost or stolen property.
• No fast food, junk food, gum, pop or toxic energy drinks allowed – try green tea instead!
• No eating in the studios, only water to drink in the studios.
• No street shoes in the studios.
• No touching or leaning against the mirrors please. Leave each area as you found it, or better.
• Please note this environment may contain nuts or other allergens.

Privacy Policy

STATEMENT OF POLICY

It is the policy of Blue Egg Entertainment Inc. (Blue Egg) to control the collection, use, and disclosure of personal information in accordance with all requirements set out in the Privacy Act. The Privacy Act does not apply to personal information that Blue Egg collects, uses, or discloses only for journalistic, artistic or literary purposes.

1.1 Requirements

The following requirements shall be met by Blue Egg unless exempted by the Privacy Act.

Collection of Personal Information

Unless otherwise authorized by the Privacy Act

No personal information shall be collected by Blue Egg unless it relates directly to an operating program or activity of Blue Egg.

Blue Egg shall, wherever possible, collect personal information that is intended to be used for an administrative purpose directly from the individual to whom it relates except where the individual authorizes otherwise.

Blue Egg shall inform any individual from whom it collects personal information of the purpose for which the information is being collected.

Retention of Personal Information

Personal information that has been used by Blue Egg for an administrative purpose shall be retained for such period of time after it is so used as may be prescribed by regulation in order to ensure that the individual to whom it relates has a reasonable opportunity to obtain access to the information.

Accuracy of Personal Information

Blue Egg shall take all reasonable steps to ensure that personal information that is used for an administrative purpose is as accurate, up-to-date and complete as possible.

Disposition of Personal Information

Blue Egg shall dispose of personal information under its control in accordance with the regulations and with any directives or guidelines issued by the designated minister in relation to the disposal of that information and with its corporate retention schedule.

Use and Disclosure of Personal Information

Personal information under the control of Blue Egg shall not, without the consent of the individual to whom it relates, be used or disclosed by Blue Egg except for the purpose for which the information was obtained or compiled or for a use consistent with that purpose unless otherwise authorized by the Privacy Act. In certain circumstances personal information subject to the Privacy Act may be used, or disclosed without the knowledge or consent of the individual concerned. Such circumstances include, but are not limited to personal information used or disclosed:

for the purpose for which the information was obtained or compiled by Blue Egg or for a use consistent with that purpose;

for the purpose of complying with a subpoena or warrant issued or order made by a court, person or body with jurisdiction to compel the production of information or for the purpose of complying with rules of court relating to the production of information;

to an investigative body specified in the regulations for the purpose of enforcing any laws or carrying out a lawful investigation;

to officers or employees of Blue Egg for internal audit purpose;

where disclosure would clearly benefit the individual to whom the information relates.

Personal Information Banks

Blue Egg shall include in personal information banks all personal information under its control that:

has been used, is being used or is available for use for an administrative purpose;

or is organized or intended to be retrieved by the name of an individual or by an identifying number, symbol or other particular assigned to an individual.

Access to Personal Information

Upon receipt of a written request, Blue Egg shall provide a right of access to personal information subject to the Privacy Act to:

any personal information about the individual requestor contained in a personal information bank; and any other personal information about the individual requestor under the control of Blue Egg with respect to which the individual is able to provide sufficiently specific information on the location of the information as to render it reasonably retrievable.

Individuals who are given access to their personal information may:

request correction of the personal information where the individual believes there is an error or omission therein;

require that a notation be attached to the information reflecting any correction requested but not made;

and be notified of the correction or notation, and where the disclosure is to a government institution, the institution make the correction or notation on any copy of the information under its control.

Refusal of Access to Personal Information

Blue Egg may refuse access to personal information as provided by the Privacy Act where such information, among other circumstances:

is subject to solicitor client privilege

is part of or relates to an investigative record where disclosure could be injurious to the enforcement of a law of Canada or a province or the conduct of investigation.

Where disclosure threatens the safety of individuals.

1.2 Responsibility

All Blue Egg employees, who collect, maintain and/or use personal information, are responsible for insuring that the collection, use and disclosure of this information is carried out in accordance with this policy and relevant procedures.

The Privacy Coordinator is accountable for Blue Egg’s policies and practices, with respect to the management of personal information, and is the individual to whom complaints and inquiries can be forwarded.

Privacy on the Internet

This privacy statement is applicable to all Blue Egg Websites.

Blue Egg respects the privacy of its Internet users and will protect that privacy as vigorously as possible.

Blue Egg does not collect information that personally identifies individuals except when individuals provide such specific information on a voluntary basis. There may be occasions where specific personal information is requested before an individual can enter certain sections of a Blue Egg site. For example, registration is needed to order a training video, complete a survey, and sign up for a webinar or to enroll for live training or make a submission online. This kind of registration helps us to ensure that content standards on these sections of the site are rigorously upheld or that contact can be made with customers or prize winners. Information requested in order to personalize the BlueEggEntertainment.com homepage or any other Blue Egg site section would be a similar example.

In all such cases, Blue Egg will collect only information that is voluntarily provided by the user and undertakes that such information will be kept strictly confidential. Individual information provided to Blue Egg to gain access to any Blue Egg site will not be sold or made available to a third party.

Blue Egg does reserve the right, however, to perform statistical analyses of user behaviour and characteristics, in order to measure interest in and use of the various sections of its sites and its products and services offered so as to improve product and services offered, design and navigation of the sites and to gather marketing information. Only aggregated data from these analyses, not individual data, will be used for this purpose.

As well, users should be aware that certain non-personal information and data may be automatically collected by Blue Egg through the operation of what are called “cookies”. “Cookies” are small text files that identify an individual computer’s browser entering a website. They allow the site to track that browser’s movement through the site over several sessions. They allow the site to track what website a user visited just before and just after the Blue Egg site. Through cookies, a website can recognize repeat users, facilitate the user’s access to and use of the site and allow a site to track usage behaviour that will allow content improvements. Blue Egg uses cookies only for the above-mentioned purposes and will not use them to identify users.

If you do not want a cookie placed on your computer by Blue Egg, you may disable cookies altogether by modifying the preferences or options menus in your web browser. Note that it is possible that some aspects of Blue Egg sites may be unavailable to you if you choose this option.

UNDER NO CIRCUMSTANCES SHALL Blue Egg AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS LICENSORS, BE LIABLE FOR ANY INJURY, LOSS, DAMAGE (INCLUDING SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES) OR EXPENSE ARISING IN ANY MANNER WHATSOEVER FROM (I) THE ACTS, OMISSIONS OR CONDUCT OF ANY THIRD-PARTY USER; AND (II) ANY USE OR INABILITY TO USE ANY MATERIALS, SOFTWARE, CONTENT, GOODS OR SERVICES LOCATED AT OR MADE AVAILABLE AT ANY WEBSITE LINKED TO OR FROM THE WEBSITE.

IF YOU DECIDE TO ACCESS OR USE ANY LINKED WEBSITE OR CONTENT, MATERIALS, SOFTWARE, GOODS OR SERVICES FROM A WEBSITE LINKED TO THE WEBSITE, YOU DO SO ENTIRELY AT YOUR OWN RISK.

YOU HEREBY RELEASE Blue Egg AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND THEIR RESPECTIVE SUCCESSORS AND ASSIGNS, FROM ANY DAMAGES THAT YOU INCUR, AND AGREE NOT TO ASSERT ANY CLAIMS AGAINST THEM, ARISING FROM YOUR PURCHASE OR USE OF ANY PRODUCTS OR SERVICES MADE AVAILABLE THROUGH THE WEBSITE OR BY THIRD PARTIES THROUGH THE WEBSITE.

Software Licenses and Ownership

All software embedded in or located on or at the Website, including, without limitation, all computer code of all types, including all files, text, video, audio, movie and/or images contained in or generated by such software (Software) is protected by copyright and may be protected by other rights. All such Software is owned by Blue Egg, its licensors or the party accredited with ownership of such Software. You are hereby granted the right to access and use the Software embedded and integrated into the Website, subject to (i) the terms and conditions of this Agreement, and (ii) any additional conditions which may be imposed on your access and use of such Software.

If the Website provides Software for download, unless otherwise provided, you are hereby granted, subject (i) to the terms of this Agreement and (ii) to any other terms and conditions that may apply to your downloading and use of such Software, a personal, non-transferable, non-exclusive license to (i) install and run one copy of the Software in object-code format on a non-networked computer for your personal, non-commercial use; and (ii) to reproduce the Software only as reasonably required to install, run and make reasonable backup copies as allowed by law.

Except to the extent expressly permitted in this Agreement, you may not: (i) use, reproduce, modify, adapt, translate, upload, download or transmit the Software in whole or in part; (ii) sell, rent, lease, license, transfer or otherwise provide access to the Software; (iii) alter, remove or cover any trademarks or proprietary notices included in the Software; and/or (iv) decompile, disassemble, decrypt, extract or reverse engineer the Software or assist others in doing so.

Nothing contained in the Website shall be construed as granting you any right, title, interest or other license in or to any Software embedded or integrated into the Website or made available for download from the Website, including, but not limited, to any intellectual property rights in the Software. With the exception of specific products for which a limited license may be available for purchase for personal use and then the license granted to the purchaser is limited to the extent expressly permitted in the product description.

All Software embedded or integrated into the Website is provided As Is, without warranties of any kind, either expressed or implied, including, without limitation, any warranty (i) that the Software is of merchantable quality or is fit for any particular purpose; (ii) that the Software will conform with any specification(s) relating to the Software; (iii) that the Software will be free from material defects; (iv) that the Software contains no computer viruses or other contaminants; or (v) that the Software shall process date-related and time-related data without causing any processing interruptions, abnormal termination or process or manipulate any time-related data.

Online Commerce

The Website may allow you to purchase many different types of products and services online that are provided by Blue Egg (the Wares and Services). When ordering Wares and Services on the Website, you must provide complete and accurate personal information consisting of your name, address, telephone number, email address, credit card information and shipping address, as well as any other information requested.

Your receipt of an electronic form or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Blue Egg may first provide you with a confirmation that your order has been received before we commit, confirm or complete the order requested. Your submission of an order to us shall be deemed to constitute an offer to purchase, which shall remain open for a reasonable time, unless we agree otherwise. Your offer to purchase will be deemed to be accepted by us only upon shipment of the Wares and Services or in the case that the Wares or Services are not to be shipped but instead to be received by you personally at a physical location, such as physical training in acting, then our acceptance of your offer to purchase will be deemed only upon Blue Egg issuing you a Receipt for your purchase. Blue Egg, in its sole discretion, reserves the right at any time after receiving of your order, without prior notice to you, to supply less than the quantity you ordered of any item. Blue Egg, in its sole discretion, reserves the right at any time after receipt of your order, to accept or decline your order for any reason.

You acknowledge and agree that the price of the Wares and Services is subject to change without notice and that the Wares and Services are subject to availability. The sale of the Wares and Services is void where prohibited by law. Blue Egg, in its sole discretion, shall have the right, at any time after receipt of your order, to decline your order for any reason. In the event that the Wares and Services are listed at an incorrect price, due to a typographical error or an error in pricing information, Blue Egg, in its sole discretion, shall have the right at any time after receipt of your order, to decline your order.

The Website may allow you to purchase many different types of products and services online that are provided by third parties (the Third-Party Merchandise). Blue Egg is not responsible for the legality, quality, accuracy, timeliness, reliability or any other aspect of any Third-Party Merchandise. If you make a purchase from a third-party web hosted by the Website or linked from the Website, the information obtained during your visit to any third-party Website and the information that you give, such as your credit card number and contact information, is collected by the third-party Website and not by Blue Egg.

You release Blue Egg and its officers, directors, employees, agents and their respective successors and assigns from any damages that you incur, and agree not to assert any claims against them, arising from your purchase or use of the Wares and Services or Third-Party Merchandise made available on the Website or by third-party Websites through the Website.

Registration

To use certain features of the Website, you may be asked to register with the Website. You agree (i) to provide true, accurate, current and complete information about yourself as prompted by any registration form; and (ii) to maintain and promptly update the information you provide to keep it true, accurate, current and complete. Termination

Blue Egg may at any time, without notice, in its sole discretion and without cause, terminate your right to access or use the Website, (or any portion thereof). Blue Egg may also terminate your right to access and use the Website, or any part of the Website, if you breach any term or condition of this Agreement.

Trademarks

BLUE EGG ENTERTAINMENT INC., BLUE EGG ENTERTAINMENT, BLUE EGG ENTERTAINMENT & DESIGN, BLUE EGG, BLUE EGG & DESIGN are official marks or trademarks of Blue Egg Entertainment Inc. Other names, words, titles, phrases, logos, designs, graphics, icons and trademarks displayed on the Website may constitute registered or unregistered trademarks of Blue Egg or third parties. While certain trademarks of third parties may be used by Blue Egg under license, the display of third-party trademarks on the Website should not be taken to imply any relationship or license between Blue Egg and the owner of said trademark or to imply that Blue Egg endorses the wares, services or business of the owner of said trademark. Nothing contained on the Website should be construed as granting you any license or right to use any trademark logo or design of Blue Egg or any third party, without the written permission of Blue Egg or the respective owner of any third-party trademark.

The information contained on the Website is for informational purposes only. It is not intended to provide legal, accounting, health, nutritional, medical, investment,  career, parenting or other advice to you, and you should not rely upon the information to provide any such advice.

Submissions

The Website may provide features that allow you to submit written pitches, scripts, story ideas, surveys, comments, votes, post messages and content, to interact with Blue Egg and other users and to upload files, documents or other materials (collectively, Submissions). By posting or uploading Submissions to the Website, you grant Blue Egg a royalty-free, perpetual, non-exclusive, irrevocable, unrestricted, worldwide license to: (i) use, reproduce, store, adapt, translate, modify, make derivative works from, transmit, distribute, publicly perform or display such Submissions for any purpose; and (ii) to sublicense to third parties the unrestricted right to exercise any of the foregoing rights. In addition to the grant of the above license, you hereby (i) agree to waive all moral rights in any Submission in favour of Blue Egg; (ii) consent to your name, address and email appearing as the contributor of any Submission, where applicable, and to the disclosure and/or display of such information and any other information which appears in or is associated with a Submission; (iii) acknowledge and agree that Blue Egg is not responsible for any loss, damage, or corruption that may occur to your Submissions; and (iv) acknowledge and agree that any Submissions you provide for display on the Website will be considered non-confidential.

Blue Egg may review Submissions before they are posted. Blue Egg may refuse to post any Submission to the Website. Blue Egg reserves the right, in its sole discretion, to edit or remove any Submission, whether or not the Submission is in violation of the provisions hereof or otherwise objectionable. You acknowledge and agree that Blue Egg may, in its sole discretion, monitor the Website periodically and disclose any information as necessary to satisfy any law, regulation or other governmental or Court request, to operate the Website properly or to protect itself or other users of the Website. Any such disclosure shall be in accordance with Blue Egg’s Privacy Policy.

Blue Egg is not responsible for the content of any Submission. Submissions represent the views and opinions of the person(s) posting the Submission and do not represent the views or opinions of Blue Egg.

While Blue Egg is under no obligation to investigate any complaint regarding any Submission, it may, in its sole discretion, investigate complaints and take any actions it deems appropriate in the circumstances, including, without limitation, removing the offending communication from the Website and terminating the submitting party’s right to access and use the Website (or any portion thereof).

Notice and Procedure for Making Claims of Copyright Infringement

It is the policy of Blue Egg to respond to claims of intellectual property infringement. Blue Egg will promptly process and investigate notices of alleged infringement and will take any actions, in its sole discretion, it deems appropriate. To be effective, the notification of infringement must be a written communication that includes the following:

Governing Law and Jurisdiction

The Website (excluding linked Websites) is controlled by Blue Egg from its offices within the Province of British Columbia, Canada. By accessing or using the Website, you agree that all matters relating to your access to, or use of, the Website and/or the Content shall be governed by the laws of the Province of British Columbia and the laws of Canada, without regard to the conflict of laws principles thereof. You agree and hereby submit to the non-exclusive jurisdiction of the Federal Court of Canada and/or the courts of the Province of British Columbia with respect to such matters. You agree that the provisions of the United Nations Convention on Contracts for the International Sale of Goods shall not apply.
